Casual Licence for Residential Accommodation

The Guest accepts the right and privilege granted by Victor and Jurka Bulic (Owner) to occupy Level 1, 296-298 Rathdowne Street, Carlton (Terrace) during the period agreed with the Owner (Term) on the following terms and conditions:

1.The Terrace must only be used for casual accommodation and for no other purpose whatsoever.

2.The Guest’s rights under this Licence rest in contract only and the Guest does not have any rights as a tenant or hold any other estate or interest in the Terrace whatsoever.

3.The Licence is personal to the Guest and the Guest’s rights under this Licence are not transferable or assignable by the Guest in any way whatsoever.

4.The Guest must not remove, alter or interfere with any of the chattels in the Terrace or make any modifications, alterations or improvements to the Terrace during the Term.

5.This Licence shall immediately be at an end and terminate at the expiration of the Term or in circumstances where the Guest is in breach of any of the terms and conditions contained herein.

6.The Guest enters and uses the Terrace and brings any property of the Guest onto the Terrace at his or her own risk and releases to the full extent permitted by law, the Owner, its employees, agents, contractors and any person, for any loss or damage to the Guest or the Guest's property no matter how it happens.

7.The Guest indemnifies the Owner and its employees, agents, contractors and anyone he or she allows into the Terrace against any claim or proceeding that is made or commenced and against any liability, loss, damage or expense that any of them suffers or incurs as a direct or indirect result of the following:

(a). the Guest's access to or use of the Terrace;

(b). the Guest does or fails to do or someone the Guest is responsible for does of fails to do;

(c). something anyone else including a trespasser does while in the Terrace; and

(d). anything entering, leaving or affecting the Terrace.

However, the Guest does not have to indemnify the Owner to the extent that the Owner, the Owner’s employees, agents, contractors or anyone it allows in the Terrace contributed to the liability, loss, damage or expense by a negligent intentional act or commission.

8. If the reservation or any portion of the reservation is cancelled within 7 days of the date on which this Licence is due to commence, the Guest shall pay to the Owner 25% of the licence fee.

9. If the reservation is cancelled within 24 hours of the date on which this Licence is due to commence, the Guest shall to the Owner pay 30% of the licence fee.

10. On the date on which the Licence is due to expire:

(a).the Guest shall immediately vacate the Terrace and leave the Terrace and the chattels in the same good order, state and condition as they were in when occupation was entered into;

(b). if any damage is caused to the Terrace and the chattels during the Term and is not rectified and made good by the Guest before vacating or if the Guest shall not leave the Terrace and chattels in the same good order, state and condition as they were in when he / she entered into occupation, then any costs or expenses incurred by the Owner in repairing such damage shall be borne by the Guest and the Owner shall then be entitled to charge the Guest accordingly and immediately recover the same from the Guest and/or deduct the same from any monies paid to or held by the Owner which may otherwise for any reason be refundable to the Guest by the Owner.

11. The Guest agrees to:

(a). pay to the Owner the licence fee; and

(b). observe the attached rules of accommodation.

12. The Owner may end this licence by the Owner or its agents or representatives giving the Guest 3 hours prior notice if the Guest breaches any obligation under this Licence.

Rules

The Guest agrees to comply with the following Rules:

1. At all times the Terrace must be kept secure.

2. Maximum of 6 occupants to reside at Terrace unless by arrangement with the Owner.

3. There is to be no smoking at the Terrace.

4. No activities are to be engaged in that will cause a nuisance to surrounding neighbours.

5. The Terrace must be kept neat and tidy.

6. No candles, gas or oil lanterns or like objects that give off or make a flame are to be used in the Terrace.

7. No pets are to be brought into the Terrace.

8. All breakages are to be promptly reported to the Owner or its agents or representatives.

9. The Terrace must be vacated by 11.00am on the date the Licence expires unless otherwise arranged.

10. All appliances are to be used in accordance with the directions and guidelines provided by the Owner or the Owner’s agents or representatives.
